DOT permits real-time remote SAP evaluations
49 CFR 40.291 allows a qualified SAP, at the SAP's discretion, to perform the required assessment or evaluation remotely. The technology must permit real-time audio and visual interaction. Its quality must allow the SAP to obtain the visual and audible information that would otherwise be available during an in-person interaction.
The system must also provide security appropriate for protecting the confidentiality of the communication. A phone-only call, email questionnaire or prerecorded exchange therefore does not satisfy the rule's real-time audio-and-video requirement for a remote SAP evaluation.
A SAP cannot ignore professional licensing boundaries
Remote access does not give a SAP unrestricted national practice authority. Under 49 CFR 40.281(f), an otherwise qualified SAP must comply with the geographic limitations that apply to the professional credential used to qualify as a SAP.
Before scheduling remotely, confirm that the SAP can perform the evaluation for a person located where you will physically be during the appointment. This is different from asking whether a provider merely advertises virtual appointments.
The initial and follow-up evaluations may be remote
DOT's rule permits both the initial clinical evaluation and the later follow-up evaluation to be performed remotely when the regulatory conditions are met. The follow-up still requires the SAP to determine whether the employee actively participated in and successfully complied with the original education and/or treatment recommendation.
That decision remains with the SAP. Completing an online class, uploading a certificate or attending a video appointment does not independently establish successful compliance. See SAP education and treatment and the follow-up evaluation for those separate requirements.
The entire return-to-duty process is not a video appointment
Remote SAP evaluations should not be confused with remote DOT drug or alcohol testing. After successful SAP compliance, any required return-to-duty test must be conducted under the applicable DOT testing procedures. 49 CFR 40.305 requires the qualifying return-to-duty result before an employer may allow the person to resume safety-sensitive duties.
For FMCSA-regulated drivers, Clearinghouse actions are also separate from the clinical evaluation. The SAP reports required RTD-process information to the Clearinghouse, while the employer or other authorized party handles the applicable testing and reporting functions. For the complete sequence, see DOT return-to-duty process.
