Why there is no fixed SAP program length
DOT rules do not give drivers a standard 3-day, 7-day or 30-day SAP program. Under 49 CFR 40.291, the SAP evaluates the individual and determines what education and/or treatment is appropriate. That recommendation is individualized, so two people with similar violations can have different requirements and timelines.
The initial evaluation may be conducted in person or remotely when the requirements for real-time audio and video, confidentiality and the SAP's applicable credential jurisdiction are satisfied. See our online SAP evaluation guide for the remote-evaluation rules.
The steps that usually control the timeline
The process normally includes an initial SAP evaluation, completion of the SAP's prescribed education and/or treatment, and a follow-up evaluation. The SAP must determine that you successfully complied with the recommendation before the return-to-duty test can occur.
Scheduling availability can affect the first and follow-up appointments, but the largest variable is often the requirement between them. DOT does not allow the driver or employer to replace an inconvenient recommendation by shopping for a second SAP opinion. 49 CFR 40.295 specifically prohibits seeking a second SAP evaluation simply to obtain a different recommendation.
SAP compliance is not the final return-to-duty step
A successful follow-up evaluation does not itself authorize a return to safety-sensitive work. If an employer decides to return you to safety-sensitive duties, 49 CFR 40.305 requires the employer to ensure the appropriate return-to-duty test is completed first. A drug test must be negative, and an alcohol return-to-duty test must be below 0.02.
The employer still makes the employment decision. Completing the SAP requirements does not guarantee reinstatement, a particular job, CDL restoration or an immediate change to every related record. For the complete sequence, see the DOT return-to-duty process.
What can help prevent avoidable delays
Before the first appointment, confirm that the professional meets the DOT SAP qualification requirements and can provide the evaluation in your circumstances. Attend required appointments, complete the specific education or treatment prescribed by the SAP, and keep the SAP informed of completion through the process they specify.
If you are an FMCSA-regulated CDL driver, also make sure you understand who will handle the return-to-duty test and Clearinghouse reporting. Drivers without a current or prospective employer have a specific FMCSA procedure rather than simply ordering their own DOT RTD test. See return to duty without an employer.
