Clearinghouse Prohibited Status

In the FMCSA Drug and Alcohol Clearinghouse, Prohibited and Not Prohibited are regulatory status terms. They concern whether the driver may perform FMCSA-regulated safety-sensitive functions based on the information in the Clearinghouse. They are not a general judgment about the driver's CDL, health or employability.

What Prohibited status means

A Prohibited status means the Clearinghouse contains information that prevents the driver from performing safety-sensitive functions covered by FMCSA drug and alcohol rules until the applicable return-to-duty requirements are satisfied. Operating a commercial motor vehicle is one of those safety-sensitive functions.

Employers use Clearinghouse queries to determine whether a current or prospective driver is prohibited. FMCSA explains the query and status rules in its CDL Driver FAQs. A driver dealing with a newly reported violation can also review the DOT return-to-duty process.

What Not Prohibited means

Not Prohibited means the driver is not barred from FMCSA-regulated safety-sensitive functions on the basis of the information available in the Clearinghouse at that time. It does not mean that the Clearinghouse contains no historical information, that an employer must hire or return the driver to work, or that every other CDL requirement has been satisfied.

For a driver completing return-to-duty after a violation, the status generally changes from Prohibited to Not Prohibited after the required negative RTD test result is reported to the Clearinghouse by the responsible employer or authorized C/TPA. Completing the SAP's education or treatment recommendation alone does not cause that status change.

The milestones before the status can change

For an FMCSA-regulated violation requiring the SAP process, the driver first selects and designates a qualified SAP. The SAP reports the initial assessment date and later reports when the driver has demonstrated successful compliance and is eligible for RTD testing.

The next regulatory event is the return-to-duty test. DOT rules in 49 CFR 40.305 require a negative drug test result, or an alcohol result below 0.02 as applicable, before safety-sensitive duties may resume. The employer still makes the employment decision. For account-specific milestones, see who reports each Clearinghouse RTD step.

Not Prohibited does not mean follow-up testing is finished

A driver can be Not Prohibited while still subject to the SAP's follow-up testing plan. Under 49 CFR 40.307, there must be at least six unannounced follow-up tests during the first 12 months of safety-sensitive duty following return.

Those tests are separate from random testing. Their actual dates are controlled by the employer and are not to be disclosed to the driver. The Clearinghouse record is not considered fully resolved merely because the first negative RTD test has changed the driver's status.

Common questions

What you may
want to know.

Does Not Prohibited mean my Clearinghouse record is clear?

Not necessarily. It means you are not currently prohibited from FMCSA-regulated safety-sensitive functions based on Clearinghouse information. A prior violation and continuing follow-up obligations may still be part of the record.

Can I drive a CMV while my Clearinghouse status says Prohibited?

Not in an FMCSA-regulated safety-sensitive role. A driver with Prohibited status must not perform those functions until the applicable return-to-duty requirements have been completed and the Clearinghouse status permits the driver to resume them.
